Assault Laws in Texas

In Texas, an assault case occurs when an individual purposefully engages in conduct that causes another person to fear harm, regardless of physical contact. According to Texas Penal Code § 22.01(2), a threat without physical contact can lead to assault charges. However, if physical contact results in injuries, the charges and consequences become more severe.

The severity of the assault determines its classification and punishment. An assault resulting in minor injuries is a Class A misdemeanor, punishable by a fine of up to $4,000 and a jail term of up to one year.

A threat without physical harm is considered a Class C misdemeanor, with a fine not exceeding $500. More serious assault offenses, such as assaulting a public servant, a family member with a prior domestic violence conviction, a government contractor, an emergency services employee, or a security guard, are classified as third-degree felonies. As per Section 12.34, third-degree felonies carry a prison term of two to ten years and a fine of up to $10,000.
