Ignition interlocks (IIDs) are devices installed on motor vehicles that function as breathalyzers. If alcohol is detected on a person’s breath, then the ignition interlock device prevents the vehicle from starting. IIDs are often required by the court after a DWI arrest or conviction. Failure to comply with this requirement could result in a fine, the vehicle being impounded, and a longer license suspension.

When an individual’s driver’s license has been suspended for a DWI conviction, it may be possible for that person to be issued a restricted driver’s license. A restricted license permits the individual to drive when an essential need exists, such as traveling to work or fulfilling necessary household responsibilities, such as grocery shopping.

If a court orders the use of an ignition interlock device. Then the individual with the driving restriction must pay the cost of obtaining and installing it on any vehicles to be driven by that person. Once installed, the IID must remain on the vehicle(s) for the full length of the driver’s license suspension. Exceptions to IID Requirements

Ignition interlock devices are generally a requirement for second and subsequent DWIs. However, a lookback period applies to this requirement. An IID may not be required if more than ten years passed between the previous and most recent DWIs. Additionally, there are some exceptions to the general requirement that a person only operate vehicles with an ignition interlock installed. Someone may be permitted to drive without an IID in the course and scope of their employment so long as the following conditions are met:

  • The vehicle is owned by the employer
  • The employer has been notified of the restrictions on the individual’s driving privileges. As well as a copy of the notification remains in the vehicle
  • The individual with the restricted license does not own or control the employer

Installation and Removal of IIDs

When the use of an ignition interlock device has been mandated by the court, installation must be performed by a service center that is certified by the Texas Department of Public Safety. Once installed, the device must remain on the vehicle until the court authorizes its removal. IIDs can only be removed from a vehicle with either a valid court order or a vendor removal form signed by a county clerk or judge. At the end of the court-mandated period, individuals with a restricted interlock driver’s license can submit a request to the Texas Department of Public Safety to remove the restriction.
