Fraud Penalties in Midland

Midland fraud penalties vary depending on whether the alleged offense is categorized as a misdemeanor or felony. Misdemeanors are generally considered to be less serious than felonies. As such, the penalties tend to be less severe.

In Midland and throughout the state, there are three classes of misdemeanor offenses and five levels of felony charge. Fraud penalties for misdemeanor-level offenses are as follows:

• Class A Misdemeanors — Jail term of one year or less and/or a fine of up to $4,000
• Class B Misdemeanors — Jail term of 180 days or less and/or a fine of up to $2,000
• Class C Misdemeanors — Fine of up to $500

Penalties for the different types of felony offenses are as follows:

• Capital Felonies — Life in prison without parole
• First Degree Felonies — Prison sentence of five years to life and/or a fine of up to $10,000
• Second Degree Felonies — Prison sentence of 2-20 years and/or a fine of up to $10,000
• Third Degree Felonies — Prison sentence of 2-10 years and/or a fine of up to $10,000
• State Jail Felonies — Jail term of 180 days to two years and a fine of up to $10,000
