In Houston, according to Texas Statutes § 49.04, it is unlawful to drive a motor vehicle while intoxicated. A person is considered legally intoxicated in one of two ways, according to Section 49.01. Second, police may deem a person intoxicated if they have a blood alcohol concentration (BAC) of .08 or greater.

All convictions of a DUI generally require a jail sentence in Houston. But the length of incarceration depends upon the facts of the case. For a first DUI without any aggravating factors, there can be a minimum three-day jail term. Having an open container in the vehicle can increase this to a six-day jail term. Individuals who have prior DUI convictions or who registered a BAC of .15 or greater may face far more serious punishments. These can involve a lengthier jail term.

A conviction for DUI can also carry a fine ranging from $2,000 to $10,000 and a license suspension of between 90 days to two years, depending upon the severity of the case.
